In wrongful death cases, our
experts evaluate data pertaining
to a particular case and calculate measurable damages based on reliable
and relevant principles and methods
Data Gathering
To prepare an accurate report, our expert must gather data and information regarding the deceased and his/her family. Necessary information includes, but is not limited to the type of existing damages, the venue for the case, date of birth, date of injury, date of death, marital status, name and birth date of spouse (if any), name and birth date of children (if any), wages and benefits at the time of injury and/or death, projected career path of deceased, work history, medical history, and participation in a retirement or savings program. Data regarding the deceased's personal life must also be addressed.
Assumptions'
Based on the data and information gathered, our expert will make several assumptions influencing the outcome of the report. Basic assumptions include career and life expectancy of the deceased, career path, participation in a retirement or savings program and personal lifestyle.
Report and Opinions
The expert may be asked to develop a report, respond to an opposing expert's report, attend depositions, review deposition transcripts, give a depostion , and/or provide testimony at trial.
In preparing a report, the expert will rely on the data and the assumptions made to calculate the damages. The report may include lost wages and other appropriate economic losses. The calculations and opinions in the resulting report will comply with the standards set by relevant state and/or federal regulations, court decisions, and rulings. The expert's final opinion will be fair and relevant and will benefit the trier of fact in his/her effort to arrive at a fair decision.
