In a wrongful termination or
employment discrimination case, our
experts evaluate data pertaining to a particular case and
calculate measurable damages based on reliable and relevant principles
Data Gathering
To prepare an accurate report, our experts gather data and information regarding the wrongful termination or act of discrimination. Necessary information includes, but is not limited to, what type of damages exist, the venue for the case, date of birth, date(s) of termination or discrimination, nature of termination or discrimination, the vocational prognosis for a new job, vocational training needed for acquiring a new job, the prospective career path before and after the termination or discrimination, wages and benefits at the time of the termination or discrimination, current wages and benefits, projected wages and benefits, work history, relocation costs and any income from unemployement insurance or other work-related sources.
Assumptions
Based on gathered data and information, our expert will make several assumptions that affect the outcome of the report. Basic assumptions include a worker's life expectancy, the estimated date of retirement, the ability to return to work and length of time required for returning to work, the wage and benefits of a new job, and if applicable, the cost of training or relocation.
Report and Opinions
The expert may be asked to develop a report, respond to an opposing expert's report, attend depositions, review deposition transcripts, give a depostion , and/or provide testimony at trial.
In preparing a report, the expert will rely on the data and assumptions made to calculate the damages incurred by the employee. Damages may include lost salary or wages, lost benefits, and other appropriate economic losses. The calculations and opinions in the resulting report will comply with the standards set by relevant state and/or federal regulations, court decisions, and rulings. The expert's final opinion will be fair and relevant and will benefit the trier of fact in his or her effort to arrive at a fair decision.
